March 29, 2024: Members of Congress File Amicus Brief in U.S. Court of Appeals in Support of Youth Plaintiffs

30 Congressional members filed an amicus brief asking the court to permit the 21 youth plaintiffs to proceed to trial, saying the DOJ efforts to “silence Youth Plaintiffs’ efforts to vindicate their Constitutional rights.” The members also noted that DOJ has made an unprecedented seven requests for a writ of mandamus, an exceptional approach used in none of the other 40,000 cases where the U.S. is a defendant. If the latest request is granted, it would shut down Juliana before evidence is even heard.
