January 13, 2025: Members of Congress and Group of Lawyers File Amicus Briefs at SCOTUS   

43 Members of Congress, Public Justice, and the Montana Trial Lawyers Association (MTLA) submitted amicus briefs to the U.S. Supreme Court, urging the Court to grant the plaintiffs’ petition for cert and allow them to proceed to trial. 

In their brief, lawmakers argued that they have a "special interest in preserving the separation of powers" and the laws that Congress enacted giving federal courts the power to declare constitutional rights." The members also filed the brief to ensure "that the federal government fulfills its obligations to respect fundamental rights of life and liberty by safeguarding the environment for current and future generations." 

The group of lawyers raised critical arguments about the government’s use of mandamus to block the trial. The brief argues that the Ninth Circuit's decision to grant mandamus based on anticipated litigation expenses defies established legal precedent, particularly the high standard for mandamus set by the U.S. Supreme Court in Cheney v. U.S. Dist. Court.
