December 9, 2024: Filed Petition for Certiorari at SCOTUS

The Juliana 21 filed a Petition for Certiorari, seeking the U.S. Supreme Court’s intervention on the central, most contested issue of redressability and the Article III jurisdiction of federal courts— whether courts can provide declaratory relief to these plaintiffs in response to the government’s outright denial of their fundamental constitutional rights along with the systemic, ongoing harms caused by the government’s fossil fuel energy policies.

They write in their petition that courts are empowered by the Constitution and the Declaratory Judgment Act to resolve active disputes between citizens and their government when citizens are being personally injured by government policies, even if the relief is limited to a declaration of individual rights and government wrongs.
