February 13, 2026: Youth Plaintiffs File Opposition to Motion to Dismiss
The youth plaintiffs filed a memorandum opposing Defendants’ motion to dismiss, arguing that they have standing to challenge the state’s oil and gas permitting practices, which have put them in a health emergency, taking years off their lives, and therefore violating their constitutional rights to life, health, and safety. They contend there is no adequate administrative process to address these claims, that their case is properly before the court, and that the judiciary has a duty to review and protect their fundamental rights whenever such rights are invaded from whatever source.
