July 16, 2026: Youth Plaintiffs File Reply Brief in Support of Motion for Stay

While wildfire smoke blankets large parts of North America and temperatures soar, the youth plaintiffs filed their reply brief backing the motion to stay the EPA’s Repeal Rule, arguing that the case for a stay is stronger than ever and that the government has not disputed the central facts at issue.  

The brief explains that no party contests that the Repeal Rule will result in 8.81 billion metric tons (8.81 gigatons) of greenhouse gas emissions that would otherwise have been avoided, and that 942.2 million metric tons will be irretrievably locked in during the stay period alone. 

The plaintiffs contend that with standing established, a likelihood of success on the merits, and irreparable harm to fundamental rights at stake, the balance of equities favors granting the stay.
