January 16, 2026: Court Grants Motion to Dismiss    

The court granted the PSC’s motion to dismiss, stating that the plaintiffs’ claims are non-justiciable under the Political Question Doctrine and barred by Florida’s Separation of Powers Clause, as well as holding that plaintiffs lacked standing to bring their claims. This dismissal is a setback, but it is not the final word and does not silence the urgent call of Florida's youth demanding their constitutional right to a livable future. Holding the Commission accountable for violating the youth plaintiffs’ rights to life is precisely what is needed to push meaningful change.
