October 5, 2026: Parties Appear Before Utah Supreme Court for Oral Arguments
The Utah Supreme Court heard oral argument in the youth plaintiffs' challenge to the transfer of their case to a newly created three-judge panel. In early 2026, the Utah Legislature passed H.B. 392 and then H.B. 366. The youth plaintiffs argue that H.B. 366 does not apply to their claims and that it violates the Utah Constitution many times over. They are asking the Court to keep their case with its assigned district court judge. The Court heard the youths' challenge alongside similar challenges from the League of Women Voters of Utah and Planned Parenthood Association of Utah, whose cases also face transfer under the new law.
