June 30, 2026: Respondents Reply to Youth Petitioners’ Motion for Stay, and Supporting States and Private Respondents Intervene

The EPA filed a brief in opposition to the youth petitioners’ motion for stay, arguing primarily that the youth petitioners don’t have standing and providing no evidence to counter petitioners’ extensive evidence of the irreparable harm they face to constitutional rights to life, personal security, and religious freedom as well as state-protected interests in Hawaii.  

Additionally, twenty-five intervening states, with Kentucky and West Virginia leading, filed an opposition to the motion for stay, and Private respondent-intervenors (like fossil fuel industry and trucking groups) also filed a brief supporting EPA's legal claims, arguing that a stay would harm industry interests in continuing to use and sell fossil fuels. The intervenors relied on a law professor to provide declaration testimony about climate science and health, rather than actual experts in the field.
